India Introduces Updates in Plastic Waste Management Rules!

The Ministry of Environment, Forest and Climate Change (MoEFCC) has introduced amendments to the Plastic Waste Management Rules, 2016, in the “Plastic Waste Management (Second Amendment) Rules, 2023″.  

These amendments aim to enhance the nation’s plastic waste management policies. Here are the key changes:  

1. The deadline for filing annual returns for 2022-23 has been extended from October 31, 2023, to November 30, 2023.

2. The definitions for “Carry Bags” and “Producers” have been clarified.

“Carry Bags” now refer to bags made from plastic, compostable plastic, or biodegradable plastic, used for carrying or dispensing goods. It excludes bags that are an integral part of the packaging used to seal goods.   

“Producer” is defined as individuals or entities involved in the manufacture of plastic packaging. 

3. Producers, importers, or brand owners must now include their name and registration certificate number via a centralized online portal on plastic packaging.

4. Instead of yearly renewals, a new clause has been added, allowing for a one-time registration for Plastic Packaging Importing and Brand-owning Entities (PIBOs).
