Introduction

Used oil is among the most hazardous forms of industrial and automotive waste. It contains heavy metals, carcinogens, and other toxic substances that can severely damage the environment and human health. When not disposed of properly, used oil contaminates soil and water, endangering ecosystems and public well-being.

To address these risks, the Government of India has introduced Extended Producer Responsibility (EPR) for used oil under the Hazardous and Other Wastes (Second Amendment) Rules, 2023, effective from April 1, 2024. This regulation ensures that producers, importers, and recyclers are held accountable for the safe handling, collection, recycling, and final disposal of used oil.

What is Considered Used Oil?

Used oil refers to re-refined oil from crude or synthetic oil mixtures. It includes:

Used engine oil

Gear oil

Turbine oil

Hydraulic oil

Compressor oil

Transformer oil

Industrial gear oil

Heat transfer oil

Tank bottom sludges

Note: Used oil does not include waste oil.

Used Oil Waste Management

The Hazardous and Other Wastes Amendment Rules, Second Amendment Rules, 2023, were released by the Ministry of Environment, Forests, and Climate Change. This amendment became effective as of the 1st April 2024.

EPR mandates that producers and importers of base oil or lubricating oil are responsible for the environmentally sound management of used oil generated from their products. This includes the collection, recycling, and disposal of used oil through registered recyclers, ensuring compliance with prescribed recycling targets.

Who is Covered Under EPR for Used Oil?

Producer

Any person or entity that:

Manufactures and sells base or lubricating oil under its own brand

Sells products made by others under its brand

Imports base or lubricating oil into India

Used Oil Importer

Any entity that imports used oil into India.

Collection Agent

Responsible for collecting used oil from users and delivering it to authorised recyclers.

Recycler

Businesses engaged in the processing or recycling of used oil.

Note: Entities falling under more than one category must register separately under each applicable category.

Compliance Across the Supply Chain

Whether your oil is sold via dealerships, e-commerce, or third-party distributors, you are accountable for the end-of-life management of your product. Used oil must be collected by authorised agents and delivered to registered recyclers. Importers are equally responsible under these rules.

Penalties for Non-Compliance

Non-compliance with EPR obligations for used oil waste attracts environmental compensation and does not absolve entities from future responsibilities. Key consequences include:

Carry-Forward of Unmet Targets

Any shortfall in meeting annual EPR targets will be carried forward for up to three consecutive years.

Strict Action Against Misreporting

In case of false declarations or over-generation of EPR certificates by recyclers, the following penalties may apply:
