India Introduces Battery Waste Management Rules 2023

The Ministry of Environment, Forests & Climate Change (MoEFCC) has introduced the Battery Waste Management Rules of 2023, aimed at refining the Battery Waste Management Rules of 2022.

These provisions took effect on October 25, 2023, and bring important changes:

1. The updated definition of “Battery” now excludes battery components, a release from the previous inclusion of new or refurbished cells/batteries and their components.

2. Extended Producer Responsibility (EPR) now extends to batteries used for personal consumption.

3. Producers are now obligated to submit annual reports on pre-consumer waste batteries generated in the previous fiscal year.

4. The rules no longer specify an expiration date for registrations, maintaining validity unless cancelled or withdrawn by the Producer.

5. Mandatory waste battery collection, recycling, or refurbishment targets have been adjusted for Electric Vehicle Batteries of three-wheelers, including E-rickshaws, within categories L5, L5-M, L5-N, and E-cart.

6. Producers must ensure that every battery or battery pack bears an Extended Producer Responsibility registration number by March 31, 2025, at the latest.

These amendments signify a significant shift in battery waste management, promoting greater responsibility and sustainability in this critical domain.
